I., Contracting partners:

1., Smart Choice Medical Travel or SCMT

Smart Choice Medical Travel is a Limited Liability Partnership registered in England. Reg no: OC 33 99 14. Registered office: 10 Douglas close, Bognor Regis, West Sussex, PO22 7UE, England.
Smart Choice Medical Travel is acting as a third party between British clients (mainly but not solely) and Hungarian medical service providers (clinics, doctors). Smart Choice Medical Travel is not a medical service provider. Smart Choice Medical Travel is acting as a third party between the client and the medical service provider always in the best interest of the Client.

 

2., Client

The Person who signs this contract or gives consent to agreeing to contract will be referred to as Client.

 II., Smart Choice Medical Travel’s services and obligations

1)
    SCMT helps Client to find high quality affordable medical services in Hungary and introduces Client to SCMT’s partner medical service providers.
2)
SCMT works with Client as a partner but not as a representative. Smart Choice Medical Travel will arrange appointments for consultations and treatments for Client at SCMT’s partner clinics.
3)
    SCMT will provide Client with transportation between Budapest airport and Client’s accommodation on their arrival to Hungary and on their departure from Hungary. It will also transport and accompany Client to medical examinations, consultations and treatments at SCMT’s partner clinics.
4)
    If Client requires SCMT’s representative can assist Client with the booking of sightseeing, restaurants, spas and the like, but Client will be solely responsible for settling all and any costs arising directly with the service provider/operator. Under no circumstances whatsoever will SCMT be liable for any losses howsoever arising from the performance or non performance of any service provider/operator.
5)
    Smart Choice Medical Travel’s co-ordinators and representatives answer Client’s questions to their best knowledge but the information provided can not be treated as medical advice since Smart Choice Medical Travel representatives and co-ordinators don’t have medical qualifications.
6)
    SCMT corresponds with Client over the phone, in mail, email or fax while Client is in UK. During Client’s stay in Hungary he/she is frequently meet by representative of SCMT and Client is also provided a Hungarian mobile phone that can be used to contact the representative of SCMT free of charge. Mobile phone is to be returned to representative on the day of departure.

III., Client’s responsibilities and obligations

1)
Travel arrangements between Client’s home and Budapest airport are Client’s sole responsibility. Although SCMT co-ordinators may help Client to find cheap flights but booking have to be made by Client and tickets have to be paid by client.
2)
Cost of accommodation is to be paid by Client expect where treatment package price includes accommodation.
3)
    SCMT staff may assist Client with the booking of hotels, apartments, sightseeing, spas and the like, but Client will be solely responsible for settling all and any costs arising directly with the service provider/operator. Under no circumstances whatsoever will SCMT be liable for any losses howsoever arising from the performance or non performance of any service provider/operator.
4)
    Client is required to disclose certain personal information (including personal data and travel plans) and to fill out a medical questionnaire prior to treatment. It is Client’s liability to complete the questionnaire thoroughly and honestly. It is also Client’s responsibility to make sure that all the personal information provided is accurate and to immediately notify SCMT of any changes to it.
5)
    In the event that the medical examination in Hungary indicates that Client cannot be treated for medical reasons, neither SCMT nor the clinic or surgeon is responsible for any of the Client’s costs.
6)
    The clinic treating Client will give aftercare instructions and advice. It is solely Client’s responsibility to follow these instructions and advice. Should Client not follow these guides all the consequences and losses that may occur for not doing so will be Client’s sole responsibility.
7)
    In the event there are additional costs due to unforeseen complications these costs will be the Client’s extra expenses and Client will be responsible for settling these with the clinic.

IV. Liability

1)
SCMT as a third party facilitator between Client and SCMT’s partner clinics is by no means liable for any impossibility, failure or fault of medical services or after care; impossibility, failure or fault of other service or events proposed to the Client.
SCMT will not be held responsible for medical procedure disputes. In the event of any medical dispute; this must be settled between Client and the clinic / surgeon directly in accordance with Hungarian medical practice law. SCMT cannot become involved in any such dispute nor for any complaint in respect of medical procedures and facilities.
2)
SCMT’s liability is limited to a duty of care in the capacity of a third party facilitator governed by UK law.

 

V., Confidentiality

The information that Smart Choice Medical Travel collects from Client is only that required by Smart Choice Medical Travel or any partner medical service provider (clinic, surgeon) to provide Client the information, products or services requested.
The information provided by Client will be used or disclosed only for the purpose for which it was given and forwarded directly to the party it is intended for or required by law.

 

VI., Pricing information and payment terms

1. Pricing information

The quote that SCMT will supply will include Client’s treatment, transfers between Budapest airport and Client’s Budapest hotel/apartment, transfers between Client’s Budapest hotel/apartment and SCMT’s partner clinic, hospital room and nurse service(after treatments that require hospitalisation) and the services of SCMT representative in Budapest. For the services of Smart Choice Medical Travel representatives please refer to Smart Choice Medical Travel’s website.

Medication and any unforeseen complications are NOT included in SCMT’s pricelist nor are they included in the quote that SCMT will supply to Client.

Travel and accommodation costs are not included in price quoted by SCMT.
SCMT’s quotes are valid for 28 days from the date received by Client.

2. Payment terms

A, Deposit to secure fertility consultation

Client is required to pay £50 non-refundable deposit at the time of booking fertility consultation. The amount can be paid by PayPal, electronic transfer or debit/credit card. This deposit is deductable from the total fee of the consultation. In the event that Client has to delay the consultation for whatever reason the deposit will be applied toward the postponed consultation as long as that takes place within 90 days from the date of the original consultation.

B, Deposit before medical treatment

Upon confirmation of the medical treatment the Client is required to pay a deposit as set below:

a)
IUI (intra-uterine insemination) at SCMT’s partner fertility centre £100
b)
IVF (in vitro fertilisation) at SCMT’s partner fertility centre £250
c)
Endoscopic surgery at SCMT’s partner fertility centre £150
d)
      PRK  at SCMT’s partner vision clinic £120 per treatable eye
e)
PRK with wavefront analysis at SCMT’s partner vision clinic £100 per treatable eye
f)
      IntraLasik laser eye surgery at SCMT’s partner vision clinic £120 per treatable eye
g)
Cataract removal surgery at SCMT’s partner vision clinic £240 per treatable eye
h)
Dental treatment at SCMT’s partner dentistry in Budapest No deposit required
i)
Dental treatment at SCMT’s partner dentistry in London £50

The amount can be paid by PayPal, electronic transfer or debit/credit card. The deposit has to be received by SCMT at least 14 days before the planed treatment.
In case of cancelation or no-show the deposit is not refundable exception where treatment is cancelled for an unforeseen medical reason.
If the treatment has to be cancelled for an unforeseen medical reason 50% of the deposit will be refunded to client’s bank account within 14 days of the cancelation.
In the event that Client has to delay the treatment for whatever reason the deposit will be applied toward the postponed treatment as long as that takes place within 90 days from the date of the original treatment.

After the booking is taken and the deposit is paid a balance invoice will be sent to Client detailing the total cost due. Full payment is due at the beginning of treatment in Budapest.

All the information published by SCMT regarding medical procedures, risks, clinics, surgeons do not, cannot and is not intended to replace the care and treatment that only a physician  may give. All the medical information published by SCMT is only for educational purposes.
